Governing Law and Jurisdiction

At Fycus's sole discretion, it may require disputes arising from these Terms of Use or use of the Website to be submitted to final and binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association applying Florida law. Claims may be resolved only on an individual basis and not in a class, consolidated, or representative action. If a portion of this class-action waiver is unenforceable as to a particular remedy, that remedy alone will be severed and may be sought in court after arbitrable claims and remedies are resolved.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
